RENTAL OF PRIVATE VILLAS AND APARTMENTS IN BALI

TERMS & CONDITIONS


RATES

Villa rental rates listed by Balivillas.com, a division of Bali.com Ltd, are on a per night basis and quoted in US Dollars. Check-in time is 3:00 PM and check-out time is 12:00 noon on the day of departure. Late check-out is possible at extra cost of 50% of the applicable daily rate until 06.00pm. Any check-out later than 06.00pm is considered as one additional night and charged at 100% of the applicable daily rate.

Many villa owners require a 7 night minimum stay and sometimes two weeks or longer during the Christmas, New Year, Lunar New Year, Easter or Summer holidays. There is a (one-time per booking) surcharge of US$150 for bookings of less than 3 nights applicable to all villas.

Rates quoted allow for a maximum occupancy of two persons per bedroom; children below 5 years can stay in their parents' bedroom free of charge if no extra bed is required. Older children and additional guests will be subject to a per person, per day surcharge.

Rates include the services of a Balivillas.com representative to meet guests at the airport in Bali and escort them to their villa as well as assistance by the Balivillas.com Service Center until the guests' departure.

Also included is the free use of an air-conditioned car with a reliable driver for up to 10 (consecutive) hours per day from the guests' arrival to departure, salaries of all house staff, the cost of electricity, water, cleaning and gardening supplies, local taxes, and so on. All villas offered by Balivillas.com are fully equipped with linen, crockery, utensils and a supply of soap and toiletries.

Note: If the car and driver are required for more than 10 consecutive hours per day, there will be an additional charge of Rupiah 50,000 per hour for up to 4 hours; the surcharge is US$60 (for a second car and driver) if this service is required even longer.

NOT INCLUDED / ADDITIONAL CHARGES

Rates do not include baggage handling, tips, long-distance telephone, fax and telegram charges, food, soft drinks and/or liquor and wine, dry cleaning, personal items and expenses and any excessive cleaning required upon departure (such as upholstery or rug shampooing, etc).

FUNCTION FEES & "SPECIAL EVENTS"

There will be an additional fee of one night extra charge for weddings or other events if organized by other parties/companies than Balivillas.com or Romantic-weddings.com.

Meals, dance performances and other arrangements in your villa for more participants than your villa's maximum occupancy PLUS TWO other guests are regarded as "Special Events". As these usually require additional arrangements, please ask your butler or the Balivillas.com Service Center for a detailed quotation.

RESERVATION & PAYMENTS

35% Rental Deposit together with the completed Guest Reservation Form must be received by Balivillas.com before a Confirmation can be issued.

The balance payment will be charged automatically 60 days prior to your arrival to your credit card mentioned in the reservation form (without additional notice). Please see our confirmation letter for details.

The final payment consisting of the remaining balance must be received by Balivillas.com at least 60 days prior to guest arrival (or together with the Reservation Form if booked less than 60 days in advance of arrival). Failure to receive the final payment on a timely basis will make reservations subject to automatic cancellation.

All rates for accommodation in Bali are quoted in US dollars, however, in case of payment by credit card, local regulations require that all charges are made in Indonesian Rupiah converted at the rate of exchange applied by Indonesian banks for selling US dollars on the day of the debit. Any subsequent refunds will be based on the amount and currency actually received by Balivillas.com.

Although you may "lose" 2% to 4% because of these currency conversions, payment by credit card gives you valuable safeguards: in the unlikely case that anything should go wrong and you have a justified claim, you can always request a refund through your credit card company. The fact that Balivillas.com's charges are processed by all major credit card companies demonstrates Balivillas.com's good track record. All credit card issuers would refuse to do business with Balivillas.com if this would create any problems for them.

The "Internet Scambuster Site" emphasizes (newsletter dated 4/6/99): "Always use a credit card to purchase online. This protects you. Your maximum exposure is $50, and often you won't even loose that amount if you get scammed".

CHANGE OF BOOKING

A US$50 administration fee will be charged by Balivillas.com for any change of booking after a Confirmation has been issued. Changes cannot be made later than 45 days before arrival, and acceptance of any change is subject to approval by the villa's owner.

CANCELLATION & REFUNDS

Cancellation of a booking at any time will result in forfeiture of deposit(s) and payments made. Refund of monies paid for villa rental and services will be made only under the following circumstances: 1.) The villa becomes unfit for habitation and no equivalent replacement villa can be obtained. This qualifies for a 100% refund; 2.) The villa is re-booked by another party for the period of the initial booking. If only a portion of the rental time is re-booked, a pro-rata refund will be made. Any rental payments which qualify for a refund, whether in whole or pro-rata, will be subject to a deduction of a 15% administration fee.

LIABILITY

Balivillas.com acts only as agent for the villa owners, suppliers and/or contractors who are providing accommodation, transport, and services. Under no circumstances shall Balivillas.com be responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise whatsoever, however caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted, or by reason of terrorist or military action, riots, revolution, insurgency, civil war, adverse government action or inaction or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodations herein or as substituted. If any accommodations and/or services are substituted, Balivillas.com will act at all times in good faith and use its best efforts to substitute with accommodations and/or services of a type comparable to or better than those originally contracted. Balivillas.com at their sole and unfettered discretion reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodations or guest services.
